California’s Assembly passed a new law, set to take effect in 2024, that mandates large retailers to establish gender-neutral toy sections.
The law, known as AB 1084, applies to companies with 500 or more employees and requires them to provide a reasonable selection of toys that are not traditionally marketed to a specific gender.
The law states, “Unjustified differences in similar products that are traditionally marketed either for girls or for boys can be more easily identified by the consumer if similar items are displayed closer to one another in one, undivided area of the retail sales floor.” The law only applies to retailers operating within California.
Non-compliance will result in a civil penalty of $250 for the first offense and $500 for each subsequent offense. Critics argue that the law lacks clear enforcement measures and only applies to large companies.
The exact space required for the gender-neutral toy aisle is also yet to be determined.
