A man who allegedly made threats to a Fresno County judge and prosecutor will not face charges.

Fresno police arrested 34-year-old Burton Enloe on Tuesday, after he allegedly made comments to law enforcement officers, threatening to kill Fresno County Superior Court Judge Gary Orozco and Andrew Janz, a former prosecutor who is now the city attorney for Fresno.

“The charge was declined due to insufficient evidence,” a Fresno County District Attorney’s Office spokeswoman said Friday. “In order to file a case, we must believe that the evidence is sufficient enough to be able to prove the case beyond a reasonable doubt.”

Fresno police issued an internal memo earlier this week to be on the lookout for Enloe, especially at Fresno City Hall or Superior Court.

Janz said in a text to GV Wire on Friday: “Out of respect to my former colleagues at the District Attorney’s Office, I will not comment on their filing decision. I do want to thank the officers and detectives at the Fresno Police Department for putting in countless hours in investigating this case and for their concern for my safety.”

Orozco’s office did not respond to a request for comment before the publication of this story.

Enloe on Probation

Enloe was on probation after a 2022 felony domestic violence conviction. He served 113 days in jail. Orozco presided over the case, and Janz prosecuted it in part.

Jail records still list Enloe in custody as of Friday at noon for “probation and suspension.” However, listings for the two charges of threatening public officials have been removed.

Enloe appeared in court Friday for a probation hearing in front of Judge Monica Diaz. The matter was continued until April 18.

It is unclear if Friday’s hearing was in relation to Tuesday’s arrest. There is usually a 48-hour window from arrest to a potential arraignment.
