A U.S. Immigration and Customs Enforcement agent accused of attacking a 72-year-old Fresno homeowner and his daughter was released from custody Tuesday afternoon, according to Fresno County jail release records.
David Gonzalez III, 32, of McAllen, Texas, was released on bond at 3:24 p.m. Tuesday, hours after Fresno County Superior Court Judge Robert Mangano ruled he could return to his home state if he posted bail.
During Tuesday’s hearing, Gonzalez’s attorney, Brian C. Andritch, requested that his client be allowed to return to Texas while awaiting trial.
Prosecutors agreed, telling GV Wire they did not consider Gonzalez a flight risk because the court would retain jurisdiction over the case.
The judge approved the request to change the minute order to reduced Gonzalez’s bail from $57,000 to $37,000. Protective orders previously issued in the case remain in effect.
Gonzalez, who appeared in court in a wheelchair Tuesday, pleaded not guilty Wednesday, Oct. 14, to four charges stemming from an alleged Oct. 9 attack in Fresno’s Tower District.
He faces felony assault by means likely to produce great bodily injury, felony elder abuse, felony vandalism, and misdemeanor battery.
According to prosecutors, Gonzalez was found sleeping on the front lawn of a home when the 72-year-old homeowner asked him to leave. Gonzalez allegedly attacked the man and his daughter before the homeowner shot the federal agent in self-defense.
Gonzalez faces a maximum sentence of four years and eight months in custody if convicted of all charges and allegations, according to prosecutors.
His preliminary hearing is scheduled for Jan. 14, 2027, at 8:30 a.m. in Department 31 of Fresno County Superior Court.
